Release of Liability Statement

By purchasing and installing any product provided by SSMODS, you acknowledge and agree to the following Release of Liability. This Release affects your legal rights, and it is essential that you fully understand its terms before proceeding with the installation and use of the product.

Inherent Potentially Dangerous Nature of the Product:

You acknowledge that electric bicycle modification products are inherently potentially dangerous to install and use. These products may alter the speed, power output, handling, braking, and electrical characteristics of an e-bike. Use may involve risks including, but not limited to, personal injury, property damage, electrical failure, fire, loss of control, or death. You understand that improper installation, configuration, or misuse of the product can lead to hazardous and potentially dangerous situations.

Void Manufacturer Warranty:

You acknowledge that installation of a SSMODS product will likely void or affect warranties provided by the original manufacturer of your e-bike or its components. By installing this product, you accept responsibility for reviewing manufacturer warranty terms and waive the right to hold SSMODS responsible for voided warranties, denied warranty claims, or loss of manufacturer support.

Legal Compliance:

You understand and accept that the installation and use of this product may render your e-bike illegal to operate in certain locations, jurisdictions, or under specific regulations. This may include exceeding legal speed or power limits or reclassification of the vehicle. It is your sole responsibility to ensure compliance with all applicable local, state, and federal laws and regulations. SSMODS makes no representation regarding street legality.

Waiver of Rights to Litigation:

You hereby waive and release SSMODS, its owners, officers, employees, contractors, agents, affiliates, successors, and assigns from any and all claims, demands, causes of action, liabilities, damages, injuries (including death), costs, and expenses, whether known or unknown, arising out of or related to the installation, use, or operation of this product. This waiver includes, but is not limited to, claims based on negligence, product liability, strict liability, breach of warranty, failure to warn, or any other legal theory.

Assumption of Risk:

You acknowledge and voluntarily assume all risks associated with the installation, use, and operation of this product. This includes risks arising from modification of electrical or mechanical systems, increased performance capabilities, rider error, third-party use, or operation in environments for which the product was not originally designed.

Indemnification:

You agree to indemnify, defend, and hold harmless SSMODS, its owners, officers, employees, agents, affiliates, successors, and assigns from any and all claims, demands, liabilities, damages, injuries (including death), costs, and expenses, including reasonable attorney’s fees, arising out of or related to your installation, use, misuse, or resale of the product.

Severability: If any provision of this release of liability statement is found to be invalid or unenforceable, it shall not affect the validity or enforceability of any other provision, which shall remain in full force and effect.

By purchasing a product from ssmods.us and electronically signing or accepting this Release during checkout, you acknowledge that you have carefully read and fully understand the terms of this Release of Liability and the Warranty and Return Policy. You voluntarily and willingly assume all risks associated with the installation, use, and operation of SSMODS products and agree to release SSMODS from any and all claims, demands, liabilities, damages, injuries (including death), costs, and expenses.
